1. Introduction
These Affiliate Program Terms & Conditions ("Affiliate Terms") govern participation in the Maxigastro Affiliate Program operated through TradeTracker.
By participating in the program, affiliates agree to comply with these Affiliate Terms, Maxigastro's General Terms & Conditions, applicable laws, TradeTracker policies, and all relevant EU regulations.
Maxigastro reserves the right to modify these Affiliate Terms at any time.
2. Eligible Traffic Sources
Affiliates may promote Maxigastro through:
Content websites
Blogs
Industry portals
Product comparison websites
Review websites
Search engine marketing (SEM)
Display advertising
Social media marketing
Email marketing (where legally permitted)
Native advertising
Other approved promotional channels
All promotional activities must comply with applicable laws and regulations.
3. Paid Advertising and Marketing Activities
3.1 Paid Search Advertising
Affiliates are permitted to promote Maxigastro through paid advertising platforms, including but not limited to:
Google Ads
Microsoft Advertising (Bing Ads)
Meta Ads
LinkedIn Ads
Display Advertising Networks
Native Advertising Platforms
Other online advertising platforms
Affiliates may bid on:
Generic industry keywords
Product keywords
Category keywords
Competitor keywords (where legally permitted)
Maxigastro brand-related keywords
including but not limited to:
commercial kitchen equipment
catering equipment
restaurant equipment
refrigeration equipment
pizza ovens
professional dishwashers
commercial refrigeration
Maxigastro
Maxigastro.eu
Maxigastro.se
Maxigastro.dk
and similar search terms.
3.2 Brand Protection Rules
Affiliates may not:
Impersonate Maxigastro
Claim to be Maxigastro
Present themselves as an official Maxigastro website
Create advertisements that may confuse customers regarding ownership or affiliation
Affiliates are strictly prohibited from:
Registering domains containing "Maxigastro"
Registering misspellings of Maxigastro trademarks
Registering confusingly similar domain names
Creating social media profiles that appear to be official Maxigastro channels
Using Maxigastro trademarks as business names without written approval
Examples of prohibited domains include:
maxigastro-discount.com
maxigastrooffers.com
maxigastro-shop.com
maxigastroeurope.com
or similar variations.
3.3 Misleading Advertising
Affiliates may not:
Make false claims regarding products or services
Advertise non-existent discounts
Publish misleading pricing information
Misrepresent delivery times
Publish inaccurate technical specifications
Use deceptive sales tactics
All promotional content must be truthful, accurate, and up to date.
3.4 Cookie Stuffing and Artificial Traffic
The following activities are strictly prohibited:
Cookie stuffing
Forced clicks
Hidden links
Automatic redirects
Click fraud
Bot traffic
Artificial traffic generation
Any attempt to manipulate tracking or commission attribution
Violations may result in immediate removal from the affiliate program and forfeiture of unpaid commissions.
3.5 Incentivized Traffic
Cashback websites, loyalty programs, coupon websites, voucher portals, reward programs, and similar traffic sources require prior written approval from Maxigastro.
3.6 Spam
Affiliates may not engage in:
Email spam
SMS spam
Messenger spam
Social media spam
Forum spam
Automated bulk messaging
All marketing activities must comply with applicable anti-spam legislation.
4. GDPR and Privacy Compliance
Affiliates must comply with:
General Data Protection Regulation (GDPR)
ePrivacy Directive
Applicable national privacy laws
Cookie regulations
Affiliates are solely responsible for obtaining all necessary user consents for:
Cookies
Tracking technologies
Email marketing
Retargeting campaigns
Advertising audiences
Maxigastro accepts no liability for affiliate violations of privacy legislation.
5. Commission Approval
Affiliate commissions are only earned on completed and paid orders.
Maxigastro reserves the right to reject commissions relating to:
Cancelled orders
Refunded orders
Returned products
Fraudulent transactions
Duplicate orders
Invalid transactions
Breaches of these Affiliate Terms
Commission approval remains at the sole discretion of Maxigastro.
6. Order Cancellations and Returns
Maxigastro primarily serves business customers (B2B).
If an order is cancelled, refunded, returned, partially refunded, disputed, or otherwise adjusted, corresponding affiliate commissions may be reduced, adjusted, or cancelled accordingly.
Orders that have already been processed or dispatched may be treated as returns in accordance with Maxigastro's General Terms & Conditions.
7. Intellectual Property
Affiliates may use:
Approved banners
Approved logos
Product feeds
Marketing materials supplied through TradeTracker
Affiliates may not:
Modify trademarks
Remove copyright notices
Create misleading branding
Represent themselves as Maxigastro
without prior written approval.
8. Compliance with Laws
Affiliates are responsible for complying with all applicable laws in the countries where they operate, including:
Advertising laws
Competition laws
Consumer protection laws
Data protection laws
Tax regulations
Electronic communications legislation
9. Right to Suspend or Remove Affiliates
Maxigastro reserves the right to:
Reject affiliate applications
Suspend affiliates
Remove affiliates from the program
Withhold commissions related to policy violations
at any time and without prior notice where necessary to protect customers, the brand, or legal compliance.
10. Limitation of Liability
Maxigastro shall not be liable for:
Technical interruptions
Tracking failures caused by third parties
Affiliate website downtime
Lost profits
Indirect or consequential damages
Participation in the affiliate program is at the affiliate's own risk.
11. Governing Law
These Affiliate Terms shall be governed by the laws applicable to the Maxigastro contracting entity.
Any disputes arising from participation in the affiliate program shall be submitted to the competent courts of the country where the relevant Maxigastro entity is established.
